Terms of Service – Focado App

These Terms of Service (“Terms”) govern your use of the Focado mobile application (“the App”), operated by Fulmin. By installing or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Scope of these Terms

These Terms apply to your use of the Focado App, including all content, features and services made available through the App. Any deviations from these Terms are only valid if confirmed in writing by Fulmin.

2. Eligibility & minimum age

You must be at least 16 years old to use the App. By using the App, you confirm that you meet this requirement.

You agree to use the App only for lawful purposes and in accordance with applicable laws and regulations.

3. Account and security

Certain features of the App require a user account (for example, through Firebase Authentication). You are responsible for:

  • keeping your login credentials confidential;
  • ensuring your account information is accurate and up-to-date;
  • promptly notifying Fulmin of any suspected unauthorized use of your account.

Fulmin reserves the right to suspend, restrict or terminate accounts in case of misuse or violation of these Terms.

4. User content

The App allows you to create, store and share various types of information, including tasks, notes, habits, journal entries, attachments, voice notes and other content (“User Content”).

You remain the owner of your User Content. By using the App, you grant Fulmin a limited, non-exclusive, revocable license to store, process and synchronize your User Content to the extent necessary to provide and improve the App.

You represent and warrant that your User Content:

  • does not violate any applicable law or regulation;
  • does not infringe any third-party rights (including privacy, copyright or other IP rights);
  • does not contain hateful, discriminatory, defamatory, obscene, or otherwise harmful material;
  • does not contain viruses, malware or other harmful code.

5. Prohibited conduct

You agree not to:

  • use the App for any illegal, fraudulent or harmful purpose;
  • harass, threaten, defame or otherwise harm other users;
  • attempt to access accounts or data of other users without permission;
  • bypass, disable or interfere with security-related features of the App;
  • reverse engineer, decompile or attempt to derive the source code of the App;
  • transmit spam or other unsolicited communications via the App.

6. Subscriptions, purchases & payments

Some functionality in the App may be available only through a paid subscription or one-time purchase (for example, to remove ads or unlock premium modules).

Payments are processed by third-party platforms such as Google Play Billing. Their terms and refund policies apply. Fulmin does not have access to your full payment card details.

Subscriptions may automatically renew unless you cancel them in your store account (e.g. Google Play) within the required timeframe before the next billing cycle.

7. Advertisements

The free version of the App may display advertisements (e.g. via Google AdMob). Data related to ads (like advertising IDs and basic usage data) may be collected by third-party ad providers. For more information, please refer to the Privacy Policy.

If you purchase a premium or ad-free plan (where available), ads will be reduced or disabled according to the specific offering.

8. Intellectual property

All intellectual property rights in and to the App, including but not limited to the software, design, graphics, logos, trademarks and content provided by Fulmin, are owned by Fulmin or its licensors.

You may not, without prior written consent from Fulmin:

  • copy, reproduce, distribute or publicly display the App or any part of it;
  • sell, lease, sublicense or otherwise exploit the App commercially;
  • create derivative works based on the App;
  • use Fulmin’s name, logos or trademarks in a way that may cause confusion.

9. Availability and changes

While Fulmin aims to keep the App available and up-to-date, we do not guarantee uninterrupted or error-free operation. The App may be temporarily unavailable due to maintenance, updates or technical issues.

Fulmin reserves the right to modify, suspend or discontinue any part of the App, as well as to introduce new features or change existing ones. Where appropriate, we will inform users of major changes.

10. Disclaimer and limitation of liability

The App is provided on an “as is” and “as available” basis. Fulmin makes no warranties, express or implied, regarding the App’s fitness for a particular purpose, reliability, availability or accuracy of information.

To the extent permitted by law, Fulmin shall not be liable for:

  • indirect, incidental or consequential damages, including loss of profits or data;
  • damages resulting from the unavailability or malfunctioning of the App;
  • any loss or damage arising from unauthorised access to your account due to your failure to safeguard your credentials;
  • content created or shared by users within the App.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted under Belgian or EU law (for example, in cases of intent or gross negligence).

11. Termination

You may stop using the App at any time by uninstalling it from your devices. Where an account exists, you may request deletion of your account and associated data within the App (if available) or by contacting info@fulmin.be.

Fulmin may suspend or terminate your access to the App if:

  • you violate these Terms or applicable laws;
  • your use of the App causes harm to other users, to Fulmin or to third parties;
  • we are required to do so by law or by a competent authority.

12. Privacy

The processing of your personal data in connection with your use of the App is governed by our Privacy Policy. In case of any conflict between these Terms and the Privacy Policy regarding data protection, the Privacy Policy shall prevail.

13. Governing law and jurisdiction

These Terms are governed by Belgian law. Subject to any mandatory consumer protection rules under EU law, disputes shall be submitted to the competent courts of the judicial district of Ghent, Belgium.

14. Changes to these Terms

Fulmin may revise these Terms from time to time, for example in response to changes in legislation, new features or modifications to the App.

When we make material changes, we may notify you via the App or other appropriate means. The most recent version of these Terms will always be available via the website and/or in the App.
